Common use of Capital Financing Clause in Contracts

Capital Financing. On the date hereof, the Buyer is, at a minimum, "adequately capitalized," as such term is defined in the rules and regulations promulgated by the FRB and the FDIC, as the case may be. The Buyer will have available to it sources of capital and financing sufficient to fulfill its cash obligations hereunder.
