Capacity Resource Election Clause Samples
The Capacity Resource Election clause defines how a party selects or designates specific resources to fulfill capacity obligations under an agreement. In practice, this clause outlines the process and criteria for identifying which generating units, facilities, or assets will be used to meet capacity requirements, often including deadlines for notification and any necessary documentation. Its core function is to ensure both parties have clarity and certainty regarding which resources are committed, thereby reducing the risk of disputes or non-compliance with regulatory or contractual capacity obligations.
