Common use of Capacity Pricing Clause in Contracts

Capacity Pricing. In the case of the purchase of Capacity pursuant to Section 2.3, the purchase price shall be the contract price under the contract referred to in Section 4.1(b)(ii), exclusive of any penalties, liquidated damages or like amounts.

Capacity Pricing. In the case of the purchase of Capacity pursuant to Section 2.32.5, the purchase price shall be the contract price under the contract referred to in Section 4.1(b)(ii2.8(b), exclusive of any penalties, liquidated damages or like amounts.
