Common use of Capacity Commitment Clause in Contracts

Capacity Commitment. Without limiting the Seller’s obligation in section 7.2, and subject to sections 7.4(a)(i), 7.4(a)(ii), 7.4(a)(iii) and 7.4(a)(iv), the Seller will deliver and sell to the Buyer at the POI, in every On-Peak Hour in every Capacity Commitment Period, Energy in at least the amount of the Designated Capacity Commitment. [Note: This section will only be included for Sellers that made a capacity commitment in their Proposal.]
