Common use of Cancellation of forfeiture Clause in Contracts

Cancellation of forfeiture. At any time before sale or disposition under clause 9.8, the forfeiture of Units may be cancelled on such terms as the Trustee thinks fit, and will be cancelled when the Unit Holder pays to the Trustee the full amount owing in respect of such forfeited Units. In such circumstances, the Trustee must issue to the Unit Holder a statement signed by an authorised officer of the Trustee confirming that the forfeiture of such Units has been cancelled and confirming the date of such cancellation.
