By Microsoft. Microsoft will defend Enrolled Affiliate against any third-claims made by an unaffiliated third party claim to the extent it alleges that a (i) any Product or Fix made available by Microsoft for a fee and used within infringes its patent, copyright or trademark or makes unlawful use of its Trade Secret, or (ii) that arises from Microsoft’s provision of an Online Service in violation of laws applicable to all online services providers. Microsoft will pay the scopeamount of any resulting adverse final judgment or approved settlement. This does not apply to claims or awards based on (i) Customer Data;
