By CMC Sample Clauses
By CMC. From the date of this Agreement to and including the Closing Date, except as may be first approved by NVPR or as is otherwise permitted or contemplated by this Agreement: (i) CMC shall conduct its business only in the usual and ordinary course; (ii) no change shall be made in the authorized capitalization of CMC except as contemplated by this Agreement; and (iii) no amendment shall be made to CMC’s Articles of Incorporation or Bylaws, except as contemplated by this Agreement.
By CMC. CMC’s rights and obligations under this Agreement will not be transferable by CMC by assignment or otherwise, except with the prior written consent of JCM.
