Buyer acknowledges that. pursuant to its right of access to the Records, the Assets, Buyer will become privy to confidential and other information of Seller and that such confidential information shall be held confidential by Xxxxx and Xxxxx’s Representatives in accordance with the terms of the Confidentiality Agreement.
