Bumps Clause Samples

The "Bumps" clause defines how adjustments to pricing, quantities, or other contract terms are handled when certain predefined events occur. Typically, this clause outlines the circumstances under which a party may increase (or "bump") fees, rates, or deliverables, such as changes in market conditions, regulatory requirements, or increased costs of materials. By specifying the process and limits for such adjustments, the clause ensures both parties understand when and how contract terms may change, thereby reducing disputes and providing a clear mechanism for managing unforeseen changes.

Bumps. A cutback or bumped employee who is disqualified will automatically lose a labor grade by first filling an open requisition, then by bumping a junior employee in:
Bumps a) The employee initiating a shift preference bump shall assume the highest hours within spread on the overtime sheet on his new shift. The employee being bumped shall assume the hours of the highest employee within spread. b) When a new shift is added to an existing department, the new employees shall assume the lower hours in spread taken from the existing shifts within their respective classifications.
Bumps. A displaced employee shall be required to meet normal production standards on any job to which the employee moves within three (3) working days except when the nature of the job requires longer time.
Bumps. An employee to be placed on indefinite layoff may exercise seniority rights to bump either (1) an employee in an occupational classification that is lower rated than that from which the employee is being laid off, or (2) an employee in an occupational classification that is equally rated to that from which the employee is being laid off, provided the employee holds current certification(s) in the occupational classification or has occupied such occupational classification prior to the bumping process. He may only bump an employee of lesser seniority and will be required to bump the least senior employee of that occupational classification. To bump, an employee must be capable and able to initially perform the work without loss of efficiency. An employee who fails or declines to exercise bumping right at the time of layoff will then remain on layoff until his seniority entitles him to recall.
Bumps a) An employee placed on indefinite layoff will report to the Human Resources Department of the Company for an exit interview, at which time they will complete a "Recall and Bump Form", two copies of which will be given to the employee, one of which will be furnished to the Union by the employee. The positions listed on the "Bump and Recall Form" will not be taken lightly and the employee involved should have a real conviction that he or she can perform the jobs listed. Cross-training records will also be used to determine the eligibility of employees to bump into another classification. There will be no obligation on the part of the Company to return an employee to work other than to their regular classification until they have completed the Bump and Recall form. b) When bumping, a qualified employee may bump into a classification of their choice and on a shift of their choice. They may only bump in the same labor grade of their regular classification or to a classification in a lower paid labor grade. They may only bump an employee of lesser seniority and will be required to bump the least senior employee of that classification on the shift of his choice whose job they are qualified to perform. Seniority will be determined by the employee's original date of hire. c) The determination of an employee's qualification to perform a job entered on their "Recall and Bump Form" will be made following the exit interview. If they are disqualified, the reasons for such disqualification will be reduced to writing and given to the employees and the Area ▇▇▇▇▇▇▇. d) In exercising bumping rights, an employee must first exhaust all possibilities in the classification from which laid off or bumped, except that they will not be required to change shifts. e) When exercising bumping rights, an employee will not be trained to do the job; however when an employee bumps into a classification of their choice as provided in Paragraph 91 c. above, the Area ▇▇▇▇▇▇▇ and a member of Management will mutually agree on a specified period of time, during which the employee will be given, with suitable orientation, an opportunity to demonstrate that they can satisfactorily perform the job. If it is then found that they cannot satisfactorily perform the job, they will be laid off and allowed to exercise their seniority rights. f) An employee who declines to bump at the time of layoff will so state on his Recall and Bump form. They will then remain on layoff until recalled; refer to Recall...
