Building Height. The maximum height of the building shall be as set forth on the Project Plans. In the event that any inconsistencies exist between the Zoning Ordinance and the building height allowed by this Agreement, then the building height allowed by this Agreement shall prevail.

Building Height. Residential Height is limited to a number of habitable floors (i.e., stories) exclusive of the area below the Ground Floor Level. One-half story is a habitable floor which has square footage that is no greater than one-half the square footage of the largest story. Buildings shall not exceed the number of stories and Height specified in Exhibits 13.2 and 13.3. Furthermore, except as noted below, no portion of a residential building (excluding fireplaces, chimneys and vents) may be taller than 30 feet from Ground Floor Level within 15 feet of any property line, nor taller than 35 feet from Ground Floor Level within 20 feet of any property line, except for the Freshfields Parcels. These setbacks do not apply to internal property lines in condominium or townhouse development. The Town may grant exceptions to these setbacks for interior property lines as identified through the platting process, provided that such exceptions do not adversely impact existing Development.
Building Height. Height shall not exceed the number of commercially habitable floors (i.e., stories) exclusive of the area below the finished first floor or the maximum elevation from Ground Floor Level established in Exhibit 13.2. One-half story is a habitable floor which has square footage that is no greater than one-half the square footage of the largest story. No portion of a building may be taller than the Height above Ground Floor Level specified in Exhibit 13.8, "Commercial Bulk Standards."

Building Height. The maximum building height including all roof top plant and equipment must not exceed 12m to Xxxxxxx Street and 22m to X’Xxxxxxx Street and Geddes Avenue as defined in Sydney LEP 2012.
Building Height. Building heights will range between one and three stories and up to fifty-five feet in height, except in Parcels A and C3, where building heights up to five stories may be considered through the PUD waiver process pursuant to Sec. 17.28.110 of the LMC and the guidelines set forth in the City’s 2013 Comprehensive Plan policy for Rural Special Districts, including a requirement for clustering of buildings. Clustering shall be achieved by the recording of deed restrictions on certain portions of the property, in a form approved by the City, such that the restricted property may only be used for common open space (“Common Open Space”) as defined by the LMC and further described in Subsection C below. More specifically:
Building Height. The building is expected to consist of five (5) stories of residential units plus three (3) levels of parking. Regardless, the height of the Multifamily Project will not exceed 860 feet above mean sea level.
