Building Code 2016. The Code for the Tendering and Performance of Building Work 2016 in force pursuant to section 34 of the Building and Construction Industry (Improving Productivity) Act 2016 (Cth). Has the same meaning as in the Building and Construction Industry (Improving Productivity) Act 2016 (Cth).
Building Code 2016. (a) The Contractor complies with the Building Code 2016 (‘Building Code’). (b) The Subcontractor must comply with (and must ensure that its Lower Tier Subcontractor comply with) the Building Code. Compliance shall not relieve the Subcontractor from responsibility to perform the Subcontract, or from any liability for any defects. (c) Where a change in the Subcontract is proposed and that change would affect compliance with the Building Code, the Subcontractor shall immediately notify the Contractor’s Representative, and if requested submit a report specifying the extent to which the Subcontractor's compliance will be affected. (d) If requested by the Contractor’s Representative, the Subcontractor must provide the Contractor’s Representative with evidence, satisfactory to the Contractor, of compliance by the Subcontractor with this clause. (e) The Subcontractor shall not be entitled to any claim, including a claim for adjustment of the Subcontract Sum or the Date for Completion in complying with this clause. (f) The Subcontractor shall permit the Commonwealth and those authorised by the Commonwealth, including a person occupying a position in the Australian Building and Construction Commission (ABCC), full access to the premises and records of the Subcontractor and any Lower Tier Subcontractor to: (i) inspect any work, material, machinery, appliance, article or facility; (ii) inspect and copy any record relevant to the project and works governed by this Subcontract; and (iii) interview any person as is necessary to monitor compliance with the Building Code. (g) The Subcontractor undertakes that it and any Lower Tier Subcontractors will agree to a request from the Commonwealth, including a person occupying a position in the Australian Building and Construction Commission, to produce a specified document within a specified period, in person, by fax or by post. Building Code 2016. 20.1 The provisions of this clause 20 apply the Supplier is carrying out Building Work as defined in subsection 3(4) of the Building Code. 20.2 For the purposes of this clause 26.2, the following definitions apply: ABCC means the body referred to in subsection 29(2) of the Act.
