Breach of Compound or Product Diligence. If after Enanta followed the procedure set forth in Section 11.2.2 for asserting a breach of contract and Xxxxxx does not cure its breach for failure to use Commercially Reasonable Efforts to Develop a Candidate or Commercialize a Product in any Major Market Country, then Enanta shall have the right, in its sole discretion upon ten (10) days written notice to Xxxxxx, to designate such Candidate or Product as a Abandoned Compound.
