Common use of Boundary Agreement Clause in Contracts

Boundary Agreement. The City represents that it has valid and enforceable boundary agreement in place with the City of St. ▇▇▇▇▇▇▇, Illinois (the “SOSC”)(the “Boundary Agreement”) that (i) as between the City and the COSC, gives the City the sole right to annex and control the development of the Subject Realty, and (ii) does not expire until the year 2034. The City agrees to take all legal action that may be required to defend the validity and enforceability of such Boundary Agreement should the annexation of the Subject Realty by the City of Geneva be challenged by the City of St. ▇▇▇▇▇▇▇.

The City agrees to take all legal action that may be required to defend the validity and enforceability of such Boundary Agreement should the annexation of the Subject Realty by the City of Geneva be challenged by the City of St. ▇▇▇▇▇▇▇challenged.
