Common use of BINDINGEFFECT Clause in Contracts

BINDINGEFFECT. Forwarding this Agreement to the Allottee by the Promoter do notcreateabindingobligationonthepartofthePromoteror theAllottee until, firstly, the Allottee signs and delivers this Agreementwith all the schedules along with the payments due as stipulated inthe Payment Plan within 30 (thirty) days from the date of receipt bytheAllotteeandsecondly,appearsforregistrationof the samebeforetheconcernedSub- Registrar,WestBengalasandwhenintimatedbythePromoter.IftheAllotteefails to execute anddeliver to the Promoter this Agreement within 30 (thirty) days fromthe date of its receipt by the Allottee and/or appear before the Sub- RegistrarforitsregistrationasandwhenintimatedbythePromoter, then the Promoter shall serve a notice to the Allottee forrectifying the default, which if not rectified within 30(thirty) daysfromthedateofitsreceiptbytheAllottee, application of theAllottee shall be treated as cancelled and all sums deposited by theAllotteeinconnectiontherewithincluding the booking amountshallbereturnedtotheAllotteeafter deducting cancellation charges including applicable taxes and withoutanyinterestorcompensationwhatsoever.
