Common use of Bid Phase Clause in Contracts

Bid Phase. 2.1.9.1 Following Owner's approval of the Construction Documents and Final Estimate, Architect shall provide to Owner one set of reproducible construction documents. 2.1.9.2 If the lowest responsive bid on the Project exceeds the Final Estimate by 10 percent after adjustment for change in the Construction Cost Index adopted by the State Allocation Board, Owner may request that Architect amend the final drawings and specifications to rebid the Project so that bids are within 10 percent of the Final Estimate. At Owner’s request, Architect shall provide specifications which include alternate bids as deemed advisable by Owner.
