BENEFITS GUARANTEED. With respect to matters not covered by this Agreement, the State will not seek to diminish or impair during the term of this Agreement any benefit or privilege provided by law, rule or regulation for employees without prior notice to DC-37; and, when appropriate, without negotiations with DC-37; provided, however, that this Agreement shall be construed consistently with the free exercise of rights reserved to the State by the Management Rights Article of this Agreement.

BENEFITS GUARANTEED. All existing rules, regulations, practices, benefits and general working conditions previously provided and allowed by the Authority, unless specifically excluded by this Agreement, - shall remain in full force and effect, provided, however, that this Agreement shall be construed consistently with, the free exercise of rights reserved to the Authority by Article 5 of this Agreement.
BENEFITS GUARANTEED. If at any time during the term of this Agreement, the County should decide to interpret an existing clause of this Agreement in a manner or fashion not consistent with past practice, the Union shall be notified in writing at least thirty (30) days prior to said change.

With respect to matters not covered by this Agreement, the State will not seek to diminish or impair during the term of this Agreement any benefit or privilege which has been determined by PERB to be a mandatory subject of negotiations or provided by law, rule or regulation for employees without negotiations with the Union; provided, however, that this Agreement shall be construed consistently with the free exercise of rights reserved to the State by the Management Rights Article of this Agreement.
