Behind Schedule. Seller shall provide prompt written notice to Buyer if at any ▇▇▇▇ ▇▇▇▇▇▇ becomes aware of actual or potential delays in the performance, progress or completion of the Project during the Construction Period that would jeopardize achievement of Project COD by the Project COD Target Date. Additionally, if at any time ▇▇▇▇▇ believes that achievement of Project COD by the Project COD Target Date may be in jeopardy, Buyer may provide written notice to Seller. Within five (5) Business Days of receipt of such notice from Buyer or Seller’s notice to Buyer of a delay, Seller shall propose a commercially reasonable written recovery plan to overcome the delay in the performance, progress or completion of the Project during the Construction Period identified by ▇▇▇▇▇ or Seller, as applicable.
Behind Schedule. Should the Work fall behind schedule, Subcontractor shall provide a written plan of action with means by which Subcontractor intends to regain compliance with the schedule. Subcontractor shall work overtime, weekends, bring in additional personnel, or provide any other measures necessary to comply with the schedule without additional expense to Contractor.
