Before the Final. Agreement the Parties may develop a process for the purchase of guide outfitter licences which may not be part of the Final Agreement.
Before the Final. Approval Hearing, the Settlement Administrator shall create a comprehensive list of successful Opt-Outs. The Parties shall, if possible, agree as to whether a communication from or on behalf of a Person who falls within the definition of the Settlement Class is a request to Opt-Out. Mesa Labs’ Counsel and Class Counsel may dispute an Opt-Out or purported Opt-Out, and if the Parties are unable to resolve such dispute, they shall present the issue to the Court for resolution.
