Basin-Wide Augmentation Plan Costs Sample Clauses
The "Basin-Wide Augmentation Plan Costs" clause defines how expenses related to the development, implementation, and maintenance of a water augmentation plan for an entire basin are allocated among the parties involved. Typically, this clause outlines the types of costs covered, such as infrastructure improvements, administrative fees, or monitoring expenses, and specifies the method for dividing these costs, whether by proportional water usage, acreage, or another agreed metric. Basin-Wide Augmentation Plan Costs.
i. Costs due at execution of this Agreement: At the time of execution of this Agreement, Lessee shall pay to Clear Creek $12,250, which is comprised of:
Basin-Wide Augmentation Plan Costs.
i. Cost paid prior to execution of this Agreement: Prior to execution of this Agreement, ▇▇▇▇▇▇ paid a one-time New Customer Application Fee of $2,000 to Clear Creek.
ii. Costs due at execution of this Agreement: At the time of execution of this Agreement, Lessee shall pay to Clear Creek $10,837.50 which is comprised of:
(1) A one-time Augmentation Participation Fee of $10,000;
(2) The Annual Augmentation Plan Administrative Fee of
(3) The cost of the 0.035 acre-feet of Water, which includes
iii. Costs due at the beginning of each subsequent Water Year:
(1) At the beginning of each Water Year during the term of this Agreement, Lessee will pay to Clear Creek the cost of the full amount of Water stated in its Projected Monthly Water Augmentation Notice and any applicable Water Reservation Rate.
(2) At the beginning of each Water Year during the term of this Agreement, Lessee will pay the then-current Administrative Fee to Clear Creek. The current Administrative Fee is $750, and each Water Year, the Administrative Fee automatically will change to Clear Creek’s then-current Administrative Fee as described above. However, if there has been no change to the Administrative Fee during the prior Water Year, the Administrative Fee will be adjusted annually for inflation in accordance with the Denver-Aurora- Lakewood metropolitan area Consumer Price Index for All Items, All Urban Consumers (CPI-U) published by the United States Department of Commerce (or, if that is unavailable, the most nearly applicable index selected at the discretion of Clear Creek).
Basin-Wide Augmentation Plan Costs. The price for Lessee’s participation in the Basin-Wide Augmentation Plan pursuant to this Agreement shall consist of the following:
i. A one-time New Customer Application Fee of $2,000; and
ii. A one-time Augmentation Participation Fee of $10,000, which Clear Creek has agreed that Lessee may pay over five years in installments of $2,000 annually (in the event that Clear Creek terminates this Agreement after less than five years, any remaining unpaid balance on the Augmentation Participation Fee will be waived); and
iii. The then-current Annual Augmentation Plan Administration Fee, which is currently $750.00 per Water Year, to pay for administrative costs (“Administrative Fee”). The Administrative Fee automatically will change to Clear Creek’s then-current Administrative Fee every five years. Except in the years the Administrative Fee is adjusted in accordance with the immediately preceding subparagraph, the Administrative Fee will be adjusted annually for inflation in accordance with the Denver-Aurora-Lakewood metropolitan area Consumer Price Index for All Items, All Urban Consumers (CPI-U) published by the United States Department of Commerce (or, if that is unavailable, the most nearly applicable index selected at the discretion of Clear Creek).
Basin-Wide Augmentation Plan Costs. The price for Lessee’s participation in the Basin-Wide Augmentation Plan pursuant to this Agreement shall consist of the following:
i. Costs paid prior to execution of this Agreement: At the time of execution of this Agreement, ▇▇▇▇▇▇ has already paid the following fees to Clear Creek:
(1) A one-time Augmentation Participation Fee of $10,000; and
(2) A one-time New Customer Application Fee of $2,000.
ii. Costs due at execution of this Agreement: At the time of execution of this Agreement, ▇▇▇▇▇▇ has already paid to Clear Creek $3,030 which is comprised of:
(1) The Annual Augmentation Plan Administrative Fee of $750 to pay for administrative costs, which fee may be adjusted in the future by Clear Creek to reflect increased administrative costs (“Administrative Fee”); and
(2) The annual cost of the 0.456 acre-feet of Water that Lessee received during the current Water Year (2023 – 2024), which is $1,140 (based on 0.456 x $2,500); and
(3) The annual cost of the 0.456 acre-feet of Water for the upcoming Water Year (2024 – 2025), which is $1,140.
iii. Costs due at the beginning of each subsequent Water Year:
(1) At the beginning of each Water Year during the term of this Agreement, starting with the 2025 – 2026 Water Year, Lessee will pay to Clear Creek the cost of the full amount of Water stated in its Projected Monthly Water Augmentation Notice and any applicable Water Reservation Rate.
(2) At the beginning of each Water Year during the term of this Agreement, Lessee will pay the then-current Administrative Fee to Clear Creek. The current Administrative Fee is $750, and each Water Year, the Administrative Fee automatically will change to Clear Creek’s then-current Administrative Fee as described above.
