Baseball/Softball i. TENANT will be responsible for scheduling at six existing baseball / softball fields for TENANT’s fall, spring, and summer seasons, which beginning and ending dates shall be scheduled with Landlord prior to the season and mutually agreed upon.
ii. At its own cost, TENANT must prepare these fields to get them into practice and playable condition (including the addition/maintenance of fences to two fields) and will handle all maintenance of the fields during the term of this Lease. TENANT will collaborate with designated School maintenance/grounds personnel to ensure that all materials used in field maintenance comply with School and governmental guidelines and regulations.
iii. TENANT has the ability to sublicense temporary, occasional usage of the six existing baseball and softball fields to tax exempt, nonprofit organizations who are insured and in good standing with IRS, IN SOS, and IN DOR.
1. TENANT will annually report gross revenue to the School’s Director of Finance & Operations by July 1 of each year this Lease remains in effect.
2. All revenue for these fields shall be split equally between the School and TENANT.
3. TENANT shall pay the School’s share of the revenue to the School by July 1 of each year or interest shall accrue at 1% per month if not paid by July 1.
iv. The School will offer TENANT public restroom access at the baseball/softball fields.
v. TENANT may place and then must maintain temporary port-a-lets on School property in mutually agreed upon locations during the baseball/softball season.
