Back Wages. If it is found that the employee should not have been disciplined, or that the penalty assessed him/her was too severe, then the employee's grievance shall be settled as shall be determined by the Employer and the Association at the Step 1 hearing, and the employee's payroll and personnel records shall be adjusted accordingly. If the employee is exonerated of the charges causing the suspension at the Step 1 hearing, he/she shall be compensated for all back wages to the suspension. Such wages shall be based on regular base pay hours and not include overtime, and shall be less any unemployment compensation received.

Back Wages. The Employer shall not be required to pay back wages for periods prior to the time the incident occurred provided that in the case of a pay shortage, of which the employee had not been aware before receiving their pay, any adjustments made shall be retroactive to the beginning of that pay period providing the employee files their grievance within five (5) working days after receipt of such pay.
