Back Royalties. 3.7.1 Back royalty shall be due for any unauthorised use of the Licensed Patents after January 1st 2001. 3.7.2 Any back royalties exempted on the basis of the section 3.7.1 of this Agreement will be due in the case of a termination by the Licensee or for material breach by licensee of this Agreement before December 31, 2006, together with accrued interest of 10% per annum pro rata ternporis on a monthly basis, and shall be paid within ninety (90) days after the written notice of such termination to Licensors as mentioned in the section 8.3.1 of this Agreement. 3.7.3 The back royalties shall be paid within 4 weeks after the Effective Date.
