Common use of Availability of Books and Records Clause in Contracts

Availability of Books and Records. Business Associate agrees to make its internal practices, books and records relating to the use and disclosure of PHI received from Covered Entity, or created or received, maintained or transmitted on behalf of Covered Entity, available to the Secretary of the U.S. Department of Health and Human Services for purposes of determining the Covered Entity and Business Associate's compliance with the HIPAA Standards. Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the Secretary.

Availability of Books and Records. Business Associate agrees to make its internal practices, books books, and records relating to the use and disclosure of PHI received from Covered Entity, or created or received, maintained or transmitted on behalf of Covered Entity, available to the Secretary of the U.S. Department of Health and Human Services for purposes of determining the Covered Entity and Business AssociateEntity's compliance with the HIPAA Privacy Standards. Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the Secretary.

Business Associate agrees to make its internal practices, books and records relating to its uses or disclosures of the use and disclosure of PHI received from Covered Entity, or created or received, maintained or transmitted on behalf of Covered Entity, available to Participant, or, if directed in writing, the Secretary of the U.S. Department of Health and Human Services for purposes of determining the Covered Entity and Business Associate's compliance with the HIPAA Standards. Business Associate promptly shall provide Applicable Law, subject to Covered Entity a copy of any documentation that Business Associate provides to the Secretaryattorney-client and other applicable privileges.

Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the SecretaryPrivacy and Security Rules as set forth in 45 CFR § 160.310.

Business Associate promptly shall provide to Covered Entity a copy term of any documentation that Business Associate provides to this Agreement and for five years following the Secretaryfinal payment under the Agreement.

Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the SecretaryPrivacy Rule.

Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the SecretaryHIPAA.

Business Associate promptly shall provide to Covered Entity a copy Privacy and Security Standards of any documentation that Business Associate provides to the SecretaryHIPAA.

Business Associate promptly shall provide to Covered Entity a copy of any documentation that Business Associate provides to the SecretaryPrivacy and Security Rules.
