Availability Charges Sample Clauses
The Availability Charges clause defines the fees or payments that are due based on the availability of a service, facility, or equipment, regardless of actual usage. Typically, this clause outlines how charges are calculated when the contracted resource is ready and available for use, such as a standby fee for equipment or a minimum payment for reserved capacity. Its core function is to ensure the provider is compensated for maintaining readiness and reserving resources, thereby allocating the risk of underutilization to the customer and providing financial predictability for both parties.
Availability Charges. If the Facility is subject to the terms of the Availability Standards, Non-Availability Charges, and Availability Incentive Payments as contemplated under Section 40.9 of the CAISO Tariff, any Availability Incentive Payments will be for the benefit of Seller and for Seller’s account and any Non-Availability Charges will be the responsibility of Seller and for Seller’s account.
Availability Charges. As a prerequisite to issuance of a connection permit for individual units and users to the Facilities, the Authority shall charge availability and other charges as provided in its Rates, Rules and Regulations as the same are in effect at the time the payment is made.
