Availability Bonus Clause Samples
Availability Bonus. During each Summer Month of the Services Term in which the Availability of the Units is 99% or greater, AA for the Units, measured as a percentage, shall be 102%.
Availability Bonus. (i) The Capacity Payment payable by Party B shall be increased by an amount (the "Availability Bonus") calculated as follows: if the Availability of any Designated Unit during Peak Times of any Designated Month (each, in respect of the relevant Designated Unit, the "Peak Time Unit Availability") is greater than 86%, then, subject to Section 8(c)(ii), the Availability Bonus for such Designated Unit in respect of such Designated Month shall equal: For AL 1 $4,039 multiplied by (Peak Time Unit Availability minus 86%), For AL 5 $11,077 multiplied by (Peak Time Unit Availability minus 86%), For AL 6 $11,077 multiplied by (Peak Time Unit Availability minus 86%), For HB 1 $5,000 multiplied by (Peak Time Unit Availability minus 86%), For HB 2 $5,000 multiplied by (Peak Time Unit Availability minus 86%), and For RB 6 $4,008 multiplied by (Peak Time Unit Availability minus 86%). If the Peak Time Unit Availability is less than 86%for a Designated Unit, then the Availability Bonus for such Designated Unit for such Designated Month shall be zero.
(ii) From the Start Date through calendar year 2004, Availability Bonus amounts calculated pursuant to Section 8(c)(i) shall be reduced by 50%.
Availability Bonus. If a Signal Technician is available for all weekly standby roster blocks referred to in Clauses 3.1.1, 3.1.2 and 3.1.4 (ie not requiring management to organise a replacement Signal Technician for the particular rostered week), the Signal Technician will be paid the applicable “Availability Bonus”. The “Availability Bonus” will still apply if the Signal Technician, as the normal rostered Signal Technician, arranges a swap with another Signal Technician.

6.9.2 If the Service Commencement Date is later than the Contract Service Commencement Date for any Block, then, for all Peak Hours between the Contract Service Commencement Date and the Service Commencement Date, there shall be considered to be Undelivered Energy for such Block for the purpose only of calculating Availability for the applicable Summer under this Section 6.9.
6.9.3 If Georgia Power declares an Excused Force Majeure Event for any Unit during the Summer, then, for all Peak Hours during the suspension due to the Excused Force Majeure Event, there shall be considered to be Undelivered Energy for the Block associated with such Unit for the purpose only of calculating Availability for the applicable Summer under this Section 6.9.
Availability Bonus. 6.9.1 For the Summer of each Year, LEM shall pay to Georgia Power a lump sum bonus of [redacted].
6.9.2 If the Service Commencement Date is later than the Contract Service Commencement Date for any Block, then, for all Peak Hours between the Contract Service Commencement Date and the Service Commencement Date, there shall be considered to be Undelivered Energy for such Block for the purpose only of calculating Availability for the applicable Summer under this Section 6.9.
Availability Bonus. A. Employees subject to this Agreement will be provided with an annual bonus which recognizes availability for service. An active employee in the Maintenance of Way Department who occupies a position on the seniority roster at the beginning of the year will qualify for a bonus of $700.00 at the end of the year if that employee has not laid off due to illness the entire year. For each day during the year such employee lays off due to illness the bonus will be reduced by $100.00.
Availability Bonus. (a) If for any Production Period, the Measured Average Availability for such Production Period is greater than 96% for such Production Period, Buyer shall pay Supplier a bonus for such Production Period (the “Availability Bonus”), calculated pursuant to the formula set forth below: Availability Bonus = (MAA – 96% Bonus Rate Wind TurbinePROD Where: MAA = Measured Average Availability calculated for the relevant Production Period in accordance with Section 3.2. Bonus Rate = 50% of the LD Rate. Wind TurbinePROD = The sum of net metered output (in MWh) of all Wind Turbines during the relevant Production Period, as measured by Buyer’s revenue quality meter, divided by the Measured Average Availability calculated for the relevant Production Period in accordance with Section 3.2.
(b) Buyer shall pay Availability Bonuses, if any, to Supplier within thirty (30) days after the date on which the calculation made pursuant to Section 3.2 is approved in accordance with Section 3.3; provided, that if there is a good faith dispute between the Parties regarding the calculation or the responsibility for the failure, Buyer shall pay the undisputed portion of the Availability Bonuses and the balance, if any, shall be paid upon resolution of such dispute pursuant to the dispute resolution provisions set forth in Article 12 of the Agreement.
