Common use of Automatic Adjustment of Original Capacity Nominations Clause in Contracts

Automatic Adjustment of Original Capacity Nominations. If one or more Participants shall fail to cure a default as provided in Section 3.05, the Original Capacity Nomination of each Participant (including any Participant in default] shall, after all Project Contributions have been made, be automatically adjusted to an amount, expressed in megawatts, equal to PC(i) OCN(i) = OCN(t) X ----- PC(t) where OCN(i) is the adjusted Original Capacity Nomination of the Participant, OCN(t) is the total of the Original Capacity Nominations of all Participants, PC(i) is the total of the Project Contributions made by such Participant, and PC(t) is the total of the Project Contributions made by all Participants (including any Participants in default).
