Common use of Authorized Claimant Clause in Contracts

Authorized Claimant. “Authorized Claimant” means Named Plaintiff, a Class Member, or the authorized legal representative of such a Class Member, who timely files a Claim Form (and does not file an Opt-Out Statement) in accordance with the terms of this Agreement, and who is therefore entitled to receive a Settlement Check. Claimants who previously accepted an Offer of Judgment pursuant to Federal Rule of Civil Procedure 68, and were compensated, are excluded from the definition of “Class” “Class Members” and “Authorized Claimants.”

Authorized Claimant. “Authorized Claimant” means Named PlaintiffPlaintiffs, a Class Member, Member or the authorized legal representative of such a Class Membermember, who timely files a Claim Form (and does not file an Opt-Out Statement) in accordance with the terms of this Agreement, and who is therefore entitled to receive a Settlement Check. Named Plaintiffs are deemed Authorized Claimants who previously accepted an Offer upon execution of Judgment pursuant to Federal Rule of Civil Procedure 68, this Agreement and were compensated, are excluded from the definition of “Class” “Class Members” and “Authorized Claimantsneed not return a Claim Form.”
