Common use of AUTHORISED INVESTMENTS Clause in Contracts

AUTHORISED INVESTMENTS. Any moneys which under the trusts of this Deed ought to or may be invested by the Security Trustee (or by the Cash Manager on its behalf) after the occurrence of a Fourth Issuer Note Event of Default may be invested in the name of the Security Trustee or in the name of any nominee on its behalf and under the control of the Security Trustee in any Authorised Investments and the Security Trustee may at any time vary or transfer (or direct the Cash Manager to vary or transfer) any of such Authorised Investments for or into other such Authorised Investments as the Security Trustee at its absolute discretion may determine, and shall not be responsible (save where any loss results from the Security Trustee's fraud, wilful default or negligence or that of its officers or employees) for any loss occasioned by reason of any such investments whether by depreciation in value or otherwise, provided that such Authorised Investments were made in accordance with the foregoing provisions.

Any moneys monies which under the trusts of this Deed ought to or may be invested by the Security Trustee (or by the Cash Manager on its behalf) after the occurrence service of a Fourth Issuer Note Event of Default Master Intercompany Loan Acceleration Notice may be invested in the name of the Security Trustee or in the name of any nominee on its behalf and under the control of the Security Trustee in any Authorised Investments and the Security Trustee may at any time vary or transfer (or direct the Cash Manager to vary or transfer) any of such Authorised Investments for or into other such Authorised Investments as the Security Trustee at its absolute discretion may determine, and shall not be responsible (save where any loss results from the Security Trustee's fraud, wilful default or negligence or that of its officers or employees) for any loss occasioned by reason of any such investments whether by depreciation in value or otherwise, provided that such Authorised Investments were made in accordance with the foregoing provisions.
