Australia Post. 7.1. Experian holds the benefit of all of the provisions of this Agreement that refer to Australia Post on trust for the benefit of itself and Australia Post, and Experian may enforce those provisions on behalf of Australia Post.
7.2. The Third Party Provider acknowledges that, under the Head Agreement, Experian may in certain circumstances appoint Australia Post as its agent for the purposes of enforcing its rights against Third Party Provider arising out of any breach of this Agreement and pursuing any remedies against the Third Party Provider.

(c) the FWC is satisfied that the relevant decision-making body of the party requesting arbitration has considered the independent mediator’s recommendation in relation to whether arbitration is appropriate for the dispute in authorising the application for arbitration by the FWC.
42.6.3 In arbitrating the dispute the FWC may:
(a) make a determination that is binding on the parties; and
(b) use the powers that are available to it under the FW Act.
42.6.4 A decision that the FWC makes when arbitrating a dispute is a decision for the purpose of Division 3 of Part 5-1 of the FW Act. Therefore, an appeal may be made against the decision. Clauses 42.5 to 42.6 will only apply until the date on which a Party to the Agreement successfully applies to the FWC for a protected action ballot in accordance with the FW Act.
