Common use of Audit Fees Clause in Contracts

Audit Fees. The Borrower hereby agrees to pay the Lender, on demand, audit fees in connection with any audits or inspections conducted by the Lender of any Collateral or the Borrower's operations or business at the rates established from time to time by the Lender as its audit fees (which fees are currently $60 per hour per auditor), together with all actual out-of-pocket costs and expenses incurred in conducting any such audit or inspection.

The Borrower hereby agrees to pay the Lender, on demand, audit fees in connection with any audits or inspections conducted by the Lender of any Collateral or the Borrower's operations or business at the rates established from time to time rate of Five Hundred Dollars ($500) per analyst per day for each audit conducted by the Lender as its audit fees (which fees are currently $60 per hour per auditor)Lender, together with all actual plus out-of-pocket costs and expenses incurred in conducting any such audit expenses; provided that except during a Default Period, the Lender shall charge the Borrower for no more than a total of four (4) audits or inspectioninspections per fiscal year.
