ASSURANCES AND COMMITMENTS. Each of the Parties affirms, acknowledges, and confirms each of its covenants, representations, agreements, undertakings, commitments, or assurances contained herein, in the FMA, and in the Permit, and, in addition, makes the following commitments and assurances.
