Common use of Assumption of Risk Clause in Contracts

Assumption of Risk. In exchange for the right for the Player to participate in the Pirate Lacrosse Programs, I hereby assume all risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Player’s participation in activities arranged by Pirate Lacrosse. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my family. I further state that I am of lawful age and legally competent to agree to this waiver and release, and that I understand the terms herein are contractual and binding. I have agreed to this release as my own free act and if I have any doubts concerning the contents of this waiver and release, I have had the opportunity to consult an attorney before agreeing to this waiver and release.

Assumption of Risk. In exchange I expressly understand and agree that the Program presents risks to me and my property and that Stanford cannot guarantee my safety. I understand and agree that the Program activities may be dangerous and may involve risks to personal safety and physical risks which can range from (but are not limited to): minor injuries such as scratches, bruises, and sprains to catastrophic injuries, including paralysis and death. I understand and agree that the Program involves international travel and may involve unfamiliar or different terrain, customs, climate, food and drink, laws, social and sexual mores, sports practices, rules and regulations, communications, criminal and law enforcement activities, disability access, driving practices and road conditions, premises conditions and/or maintenance. Risks may also include: disease, inadequate health care, natural disasters, acts of God, war, civil unrest, terrorism, kidnapping and assault, physical violence, verbal abuse, sexual abuse, short and/or long term disability, loss of income and/or career and earning opportunities. I am responsible for researching and evaluating the right risks I may face and am responsible for my actions. Any activities that I may take part in, whether as a component of the Player Program or separate from it, will be considered to participate in the Pirate Lacrosse Programshave been undertaken with my approval and understanding of any and all risks involved. This includes, I hereby assume all but is not limited to, risks associated with lacrossethe consumption of alcoholic beverages and/or drugs or other intoxicants, including the RISK OF SERIOUS BODILY INJURYproperty loss, DEATH and/or PROPERTY DAMAGE and the negligence injury to person or property, or death arising out of Pirate Lacrossetraffic accidents, assault, and theft or other activities. I hereby agree NOT TO XXX Pirate Lacrosseacknowledge that I have reviewed the advisories posted by The United States Department of State currently located at xxxx://xxxxxx.xxxxx.xxx/travel/cis_pa_tw/cis_pa_tw_1168.html and by the U.S. Centers for Disease Control health advisory at xxxx://xxxxx.xxx.xxx/travel/. I acknowledge that it is my responsibility to take every precaution to safeguard my health and personal belongings from damage or theft. I acknowledge that Stanford recommends that I never travel alone, nor their sponsorsparticularly at night. It is Participant’s intention that this assumption of all risks shall be legally binding and a complete bar to Participant, directorsParticipant’s heirs, officerspersonal representatives, employeesrelatives and assigns. This assumption of risk applies to all activities arising out of, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties associated with or resulting directly or indirectly from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the PlayerParticipant’s participation in activities arranged the Program and residing and traveling outside of the United States, including but not limited to those risks listed above. I further recognize, understand and agree that Stanford does not assume responsibility for any liability as regards damage or injury that may be caused by Pirate Lacrossemy negligence or willful acts committed prior to, during or after participation in the Program, or any liability, damage or injury caused by others, including other participants. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk that Stanford shall not be subject to claims or suit to be made by or on behalf of any illness me or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members representatives or assigns as a consequence of my family. I further state that I am of lawful age and legally competent to agree to this waiver and release, and that I understand participation in the terms herein are contractual and binding. I have agreed to this release as my own free act and if I have any doubts concerning the contents of this waiver and release, I have had the opportunity to consult an attorney before agreeing to this waiver and releaseProgram.

Assumption of Risk. I am aware that adventure travel and river rafting such as that I am undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, the negligence of Middle Fork River Expeditions, or other persons and companies known or unknown, or of wilful or criminal conduct of third parties. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. In exchange for order to partake of the right for enjoyment and excitement of this river rafting trip I am willing to accept the Player to participate in the Pirate Lacrosse Programs, risks and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of delay, unanticipated events, inconvenience, illness, emotional trauma, injury or death and of the negligence of Middle Fork River Expeditions or of any third parties. I release Middle Fork River Expeditions from its own negligence and assume all risk thereof. I agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE this trip and the negligence of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I to release the Pirate Lacrosse Parties MIDDLE FORK RIVER EXPEDITIONS from any and all liability, claims liabilities to the maximum extent permitted by law. PARTICIPATION. I acknowledge that I have voluntarily applied to participate on the trip designated on this application (or demands of every kind a trip which I may change to) and nature whatsoever which may arise out that I have read the description of the Player’s participation trip as it appears in activities arranged the current Middle Fork River Expeditions Middle Fork of the Salmon River itinerary, together with all information contained in this application. I am voluntarily participating in this trip with knowledge of the hazards involved. I also understand that MIDDLE FORK RIVER EXPEDITIONS reserves the right to refuse as a trip participant, or remove from a trip, any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or who it determines to detract from the enjoyment of the trip by Pirate Lacrosseothers. I agree NOT TO XXX to follow all written and I release verbal rules of safety presented to me by MIDDLE FORK RIVER EXPEDITIONS. MIDDLE FORK RIVER EXPEDITIONS reserves the Pirate Lacrosse Parties right to make route, itinerary and fully accept trip modifications as required or desirable to improve the risk trip quality and/or to accommodate the comfort and well-being of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my family. I further state that I am of lawful age and legally competent to agree to this waiver and release, and that I understand the terms herein are contractual and binding. I have agreed to this release as my own free act and if I have any doubts concerning the contents of this waiver and release, I have had the opportunity to consult an attorney before agreeing to this waiver and releaseguests.

Assumption of Risk. In exchange for I hereby confirm that I am a certified advanced scuba diver, and that I thoroughly understand the right for hazards of scuba diving including those occurring during boat travel to and from the Player dive site (hereinafter collectively referred to participate as “excursion”). I understand that these inherent risks include but are not limited to: drowning, air expansion injuries, decompression sickness, embolism, or other hyperbaric injuries that require treatment in a recompression chamber; slipping or falling while on board, being cut or struck by a boat while in the Pirate Lacrosse Programswater, I hereby assume all risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosseinjuries occurring while getting on or off a boat, and other perils of the sea; all of which can result in serious injury or death. I hereby understand the excursion will be conducted at a site that is remote by time and distance from a recompression chamber and emergency medical facilities, choosing by personal choice and not under the influence of alcohol or any drugs to proceed with the excursion. I understand and agree NOT TO XXX Pirate Lacrossethat neither Oniric Safari Cruises, nor their sponsorsits affiliate or subsidiary corporations, directorsowners, officers, employees, coachescrew, volunteers, instructorsdive professional(s), agents, partners, sponsors, nor any contractors or assigns of their affiliates the above listed individuals and/or entities (hereinafter “Pirate Lacrosse Released Parties”) may be held liable or responsible in any way for any personal injury, property damage, wrongful death or other damages to me that may occur as a result of my participation in this excursion, unless it is clearly proven that the incident occurred as a result of direct and I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out intentional negligence of the Player’s participation in activities arranged by Pirate LacrosseReleased Parties. I agree NOT TO XXX affirm that I am in good mental and physical health to scuba dive. If I release am taking medication, I affirm that I have seen a physician and have approval to dive while under the Pirate Lacrosse Parties influence of the medication/drugs. Furthermore, I understand that scuba diving is a physically strenuous activity, and fully accept that if I get injured during the excursion as a result of heart attack, panic, hyperventilation, drowning or any other cause, I expressly assume the risk of said injuries and that I (or any illness other third party) will not hold the Released Parties responsible for the same. Accordingly, it is my responsibility to plan my dive according to my diving experience and limitations, and the prevailing water conditions and environment. I will not hold the Released Parties responsible for my failure to safely plan my dive, dive my plan, and follow the instructions and dive briefing of the dive professional(s). I affirm it is my responsibility to inspect all of my equipment prior to the excursion and that I should not dive if my equipment is not functioning properly. I will not hold the Released Parties responsible for my failure to inspect my equipment prior to diving or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common if I choose to contact sports and injuries (including injuries that might cause death) dive with equipment that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my familynot be functioning properly. I further state that I am of lawful age and legally competent to agree to sign this waiver and releaseAgreement, and or that I have obtained the written consent of my parents or guardian. I understand the terms herein are contractual and binding. not a mere recital, and that I have agreed to signed this release as Agreement of my own free act and if with the knowledge that I have any doubts concerning the contents of this waiver and releasehereby agree to waive my legal rights. Additionally, I understand and agree that I am not only giving up my right to sue the Released Parties but also any rights my heirs, assigns or beneficiaries may have had to sue the opportunity to consult an attorney before agreeing to this waiver and releaseReleased Parties resulting from my death.

Assumption of Risk. In exchange for I certify (or certify on behalf of participants under my legal guardianship) that the right for the Player participant(s) have a sufficient level of fitness to participate in the Pirate Lacrosse Programs, sessions and that I/they are physically fit and have not been advised otherwise by a qualified medical person. I am aware that sports are potentially hazardous activities which carry with them the potential for serious injury or death. I hereby agree to assume all risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE sessions and the negligence all activities incident to them. Release of Pirate Lacrosse, and Liability I hereby agree NOT TO XXX Pirate Lacrossetake action for myself/participants and anyone entitled to act on my behalf as follows: Waive, nor their sponsorsrelease and discharge from any and all liability for my/participant death, directorsdisability, officerspersonal injury, property theft or actions of any kind however caused which may hereafter accrue to me the following entities or persons: ReadySetSweat (the parent company of Ready, Set, Splash), Coaches, employees, coaches, volunteers, instructorsrepresentatives, contractors, agents and sponsors. I indemnify and hold harmless for myself/participants the entities or persons mentioned above from any and all liabilities or claims made as a result of participation in sessions, whether caused by negligence or otherwise. I certify that I have read and agree to all of the terms and conditions stated on this form. I recognize and understand all the terms and conditions and agree to follow all the guidelines set out. Emergency Medical Treatment In the event of a medical emergency, the undersigned Participant or Parent/Guardian of the Participant(s) listed below, hereby grants authorization to ReadySetSweat and Sportsfit/Encore, its management, directors and agents, partnersits members, sponsorsassociates and employees and owner/operators, to employ any legally licensed physician or health care facility on behalf of the participant, and to direct and/or order emergency medical treatment for the participants. Each of the undersigned also agrees that neither ReadySetSweat, SportsFit/Encore, owner/operators nor any of their affiliates (“Pirate Lacrosse Parties”) respective representatives, shall be liable under any circumstances to anyone for exercising the foregoing authority in the event of an emergency. Communications and Promotional Release I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Player’s participation agree to receive informational texts for use by ReadySetSweat in activities arranged by Pirate Lacrossecommunicating with me about my lessons. I agree NOT TO XXX to receive informational and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated marketing emails from ReadySetSweat LLC with the Pirate Lacrosse Programsoption to unsubscribe at any time. I release the Pirate Lacrosse Parties hereby grant permission for videos and fully accept the risk of any damage photographs to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my familybe taken during class time. I further state understand that I am of lawful age this media may be produced and legally competent to agree to this waiver used for advertising purposes and release, and that I understand the terms herein are contractual and bindingall social media outlets. I have agreed authorize ReadySetSweat LLC to use my photograph or video on their website, printed material, and/or all social media without further consideration. I also acknowledge that ReadySetSweat LLC may not choose to use my photo/video at this release as my time but may do so at its own free act and if discretion or at a later date. I have any doubts concerning the contents of also understand that there is no compensation for this waiver and release, I have had the opportunity to consult an attorney before agreeing to this waiver and releasemedia.

Assumption of Risk. In exchange for the right for the Player I understand and accept that renting this bicycle and participating in biking exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I understand that this activity may result in hazards posed by other bicycles and traffic or road conditions among other things. I also understand I should be in good physical health to participate in the Pirate Lacrosse Programs, bicycling. I choose to participate in bicycling in spite of these risks and hereby assume all risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Player’s participation in activities arranged by Pirate Lacrosse. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk of any illness injury or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above loss of life to myself and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk loss of any or damage to property arising out of the Pirate Lacrosse Programsrenting this bicycle and participating in bicycling. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my family. I further state that I am of lawful age and legally competent to agree to this waiver and release, and that I understand the terms herein are contractual inherent risk involved in using this equipment, accept full responsibility for any and bindingall such damage or injury which may result. Waiver & Release: In consideration of RPH renting me this bicycle, I specifically release and forever discharge RPH and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bicycle or participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damaged caused by the negligence RPH or its officer agents, or employees. It is my intent by the Waiver and Release Agreement to release RPH and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence of RPH or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle or participating in bicycling, I will have no right to make a claim or file a lawsuit against RPH, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage. I REALIZE THE IMPORTANCE OF WEARING A HELMET AND I ACKNOWLEDGE THAT I SHOULD WEAR A HELMET AT ALL TIMES WHILE RIDING A BICYCLE OR TANDEM. I understand that RPH will provide me with a rental helmet at no cost. I understand that wearing a helmet is NOT a guarantee of protection from injuries. I understand how to operate the rental bicycle and brakes and how to adjust the seat and quick releases. RPH staff have agreed answered any questions that I have. I understand how to this release as my own free act wear the helmet and if how to make adjustments so that I have the proper fit. I accept full responsibility for care of the Equipment while it is in my possession. I agree to reimburse RPH for any doubts concerning loss or damage other than reasonable wear resulting from normal use. I also agree to reimburse RPH for the contents replacement cost of any Equipment rented by me but not returned. I agree that all disputes arising under this contract, the use of this waiver and releaseequipment, or from the use of the facilities at the Hotel shall be litigated exclusively in the Sixth Circuit Court for the County of Oakland, Michigan, or in the United States District Court for the Eastern District of Michigan. I have had HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. Assumption of Risk. In exchange for I understand and accept that hunting exposes me to many hazards. Some of the right for dangers and risk which may be present or occur include, but are not limited to the Player following: Hiking and walking in rugged terrain slippery logs and rocks. Accidents or illness in remote places without medical facilities. The forces of nature including lighting, weather changes, wind and others not named. The physical exertion associated with hiking, climbing, or walking terrain in southeastern Ohio area. Man-made objects including trail crossings, bridges, and other unknown structures that may be encountered. Travel in a vehicle not driven by me. Injuries inflicted by animals, insects, reptiles and/or plants. Injury or death inflicted by other hunters or outdoor enthusiast associated or not associated with Farmer Youth Initiative Program. I choose to participate in this hunting program in spite of these named risks and other unnamed risks which are inherent in this activity. I am solely responsible for deciding what equipment to take and whether or not to scout the Pirate Lacrosse Programsassigned property. I am solely responsible for deciding whether to participate or continue on any hunting trip. I assume these risks and understand my responsibility in decision making. In consideration of Washington SWCD furnishing services to enable me to participate in a hunting program, I hereby assume all risks risk of injury or loss of life to myself and loss of or damage to the property arising out of my participation in such a program, including hazards associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosse, and any defect in a manufacturer’s product. I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I specifically release the Pirate Lacrosse Parties Washington SWCD from any and all liability, including negligence, (active or passive) as to any right of action or claim to relief that may accrue either to me or to my heirs or personal representatives for any such injury, loss of life or loss of or damage to property which I may suffer while participating in such recreational activity including activates preliminary and subsequent thereto. I further hold Washington SWCD harmless from any and all liability, actions, causes of actions, debt claims or and demands of every kind and nature whatsoever whatever so which I now have or which may arise out of the Player’s from and/or in connection with my course or participation in activities arranged by Pirate Lacrosse. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my familyactivity related thereof. By participating or being involved in any of the activities offered by Queen’s University at Kingston (“Queen’s”) through Housing and Ancillary Services (the “Activities”), whether on or off campus, I hereby acknowledge, accept, and understand that I will be exposed to risks of loss including financial loss, severe injury, or death. I acknowledge the existence of known risks and potential unknown risks which may include, but are not limited to the following:  Falls to the ground due to uneven or irregular terrain or surfaces, or activities performed at heights;  Risks associated with travel to and from all venues of the various components including transport by public or private motor vehicle which could include but are not limited to an accident resulting in severe physical injuries or death;  Injuries resulting from contact, collisions, or malfunctioning structures and equipment;  Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;  Spinal cord injuries which may render me permanently paralyzed;  Being struck by other participants, spectators, equipment, or vehicles;  Vigorous physical exertion and strenuous cardiovascular activities associated with the activities;  Potential for bone and muscular skeletal injury, such as sprains and strains; episodes of light headedness, fainting, chest discomfort, leg cramps, and nausea;  Potential for xxxxx;  Failure to follow directions from those in charge of the activities; and  Loss due to theft of personal property (e.g. bags, other valuables). I release the Pirate Lacrosse Parties and fully accept understand that once minor’s participation begins, the risk of any damage to property arising out of the Pirate Lacrosse Programs. The written notice must include minor’s version of the incident, the factual basis of the claim, the name (identity or capacity of individual if name not known) of each person and/or entity who committed the wrongful conduct, and the injury caused by the wrongful conduct. I hereby assume all risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE recognize and the negligence of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Playerunderstand that my choice to allow my minor child’s participation in activities arranged any RWWJ Program(s) may place my minor in inherently risky outdoor and/or indoor activities/situations, both known and unknown, in potentially risky wilderness areas and/or environment(s) during the day and night. I fully understand that participating in a RWWJ Program(s) may include risks that include but are not limited to: exposure to forces of nature, injuries that may be associated with walking and hiking in uneven terrain (both on and off trails), tripping or falling in remote wilderness areas, effluent in river beds, other water hazards, traveling by Pirate Lacrosseauto, exposure to dangerous plants, encountering dangerous insects and animals such as, but not limited to: bears, mountain lions, Africanized bees, stinging ants, venomous snakes and other venomous animals. I fully understand that any outdoor activity requires precautionary safety measures and therefore agree to instruct my minor child to follow all directions and instructions provided by the RWWJ instructional staff. I recognize and understand that my choice to participate in any RWWJ Program(s) may place myself in inherently risky outdoor and/or indoor activities/situations, both known and unknown, in potentially risky wilderness areas and/or environment(s) during the day and night. I fully understand that participating in a RWWJ Program(s) may include risks that include but are not limited to: exposure to forces of nature, injuries that may be associated with walking and hiking in uneven terrain (both on and off trails), tripping or falling in remote wilderness areas, effluent in river beds, other water hazards, traveling by auto, exposure to dangerous plants, encountering dangerous insects and animals such as, but not limited to: bears, mountain lions, Africanized bees, stinging ants, venomous snakes and other venomous animals. I fully understand that any outdoor activity requires precautionary safety measures and therefore agree to follow all directions and instructions provided by the RWWJ instructional staff. If lodging at Raven’s Nest Nature Sanctuary, I hereby assume all risks associated agree to read the RWWJ Onsite Safety & Emergency Procedure Manual located in my Camping/Glamping site. I willingly agree to comply with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE safety terms and the negligence of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Player’s participation in activities arranged by Pirate Lacrosseconditions for participation. I agree NOT TO XXX to voluntarily remove myself from participation in any activity I deem too risky. I affirm that my participation in any RWWJ Program(s) is my own choice and I release the Pirate Lacrosse Parties assume full responsibility for all dangers and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programsrisks. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property KNOWINGLY AND FREELY ASSUME ALL THE RISKS INHERENT IN ANY/ALL RWWJ PROGRAM, even if arising out from negligence of the Pirate Lacrosse Programs. These risks may lead to tangible or intangible harm, and I agree that they may result not only from my own actions but also from the actions of others. With the knowledge and understanding of these risks, I choose, of my own will and volition, to continue participating in the Fitness Services. I am also aware that there are risks that I may not have considered, yet I waive my right for the Player to any claims that may occur from these unconsidered risks and I choose, of my own will and volition, to participate in the Pirate Lacrosse ProgramsFitness Services. COVENANT NOT TO SUE. I will not start any lawsuit or other court action against the Fitness Provider, nor will I hereby assume all risks associated with lacrossejoin any such proceeding, including any claim for money damages. I acknowledge and agree that I am entering a covenant not to sue the RISK OF SERIOUS BODILY INJURYFitness Provider in any capacity, DEATH and/or PROPERTY DAMAGE and including to hold the Fitness Provider liable for any injury, loss, or damage sustained by me or my property, even if it is due to the Fitness Provider's negligence or omission. I also waive the right of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their my insurers' to make any such claim. I hereby represent and warrant that I am and will be covered throughout the Travel Program by Pirate Lacrossea policy of comprehensive international travel insurance policy (separate from my domestic standard health insurance policy) which provides accident and illness benefits for any illnesses or injuries that I sustain or experience overseas, and, more specifically, in the country that I will be living and/or traveling while on the Travel Program. I understand that my travel insurance policy must include the following minimum benefits: emergency hospital deposits, repatriation services and emergency medical evacuation services. I understand it is recommended that this insurance also include trip interruption and cancellation coverage, personal liability coverage and standard travel assistance services. I hereby represent and warrant that my travel insurance policy will adequately cover me while outside the United States. If I require medical treatment or hospital care, in a foreign country or in the United States, during my participation in the Travel Program, WNC is not responsible for the cost or quality of such treatment or care. WNC may (but is not obligated to) take any actions it considers to be warranted under the circumstances regarding my health and safety. In exchange for the right for the Player to participate in the Pirate Lacrosse ProgramsThe undersigned, I hereby assume all risks understand and agree that, whether as a participant or spectator, there exists risk of harm associated with lacrossethe USAP Event which may give rise to bodily injury including, but not limited to, partial or total disability, paralysis and death and/or property damage. These risks include, but are not limited to, those hazards associated with strenuous activity, exposure to heat or cold weather, exhaustion, dehydration, broken bones, concussion, torn appendages, dislocations, bruises, cuts, and any other injuries that may result in physical contact with others. The undersigned further understand and agree that there may be risks and dangers not known or reasonably foreseeable at this time. I understand and agree that included within the scope of this waiver and release is any cause of action, arising from the performance of or the failure to perform maintenance, inspection, supervision or control of the USAP Event, or the failure to warn of existing dangerous conditions not known to or reasonably discovered by USA Preps, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE all acts of negligence of USA Preps. These risks and dangers may be caused by the negligence of Pirate Lacrossethe participant, participant's parent(s)/legal guardian(s), the sports facility and I hereby agree NOT TO XXX Pirate Lacrosserelated premises, nor their sponsorsor the negligence of others, directorsincluding USA Preps its officials, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) volunteers or co-sponsors and I release knowingly and voluntarily assume full responsibility for these risks arising out of or related to the Pirate Lacrosse Parties USAP Event. PERMISSION TO USE LIKENESS/NAME: The undersigned hereby grants to USA Preps or anyone authorized by USA Xxxxx, xxx permission and unlimited right to use, without compensation, participant's likeness and/or name in any form or media throughout the world, present and future, and hereby releases USA Preps from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Player’s participation in activities arranged by Pirate Lacrosse. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause deathclaim(s) that may arise during travel associated with regarding the Pirate Lacrosse Programsuse of participant's image or name, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. I release MEDICAL TREATMENT CONSENT AND RELEASE: The undersigned, hereby grants USA Preps permission to authorize medical treatment by a qualified and licensed medical provider including, but not limited to, an MD, EMT, Paramedic, Firefighter, Police Officer, Nurse, Nurse Practitioner, or Physician's Assistant, in an emergency which, in the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out opinion of the Pirate Lacrosse Programs. This release will serve as a release attending provider, may be life threatening, cause disfigurement, physical impairment, or undue discomfort if delayed and assumption of risk which binds my heirs, executors and administrators and for all members of my family. I further state that I am of lawful age and legally competent to agree to this waiver and releaseassume financial responsibility for any medical expenses directly or indirectly related thereto. Injuries could be minor such as bruises, scratches and sprains, major such as eye injuries, broken bones and concussions, or catastrophic such as paralysis, severe xxxxx or death. If the right for the Player young person is old enough to participate in the Pirate Lacrosse Programsunderstand these risks, I hereby have explained them to him or her. The young person and I (for ourselves, our heirs, family members, personal representatives and assigns) assume all risks associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosse, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties from full responsibility for any and all liability, claims injury or demands of every kind and nature whatsoever which may arise out of the Player’s participation in activities arranged by Pirate Lacrosse. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while death arising from taking part in the Pirate Lacrosse Programs (including injuries that might cause death)FAC program. INDEMNIFICATION The young person and I agree to indemnify and hold FAC harmless from any claims, costs, damages, and liabilities, including attorney’s fees, arising from the ones listed above taking part in the FAC program. This duty to indemnify and other injuries common hold FAC harmless applies even if FAC is negligent, however, indemnification is not required if FAC is grossly negligent or has engaged in willful misconduct. Soccer is a physical, contact, sport that involves the Player risks of injury, disability, and death, and involves strenuous and hazardous physical activity. I assume all risks and hazards associated with my participation in the Activity. I am in proper physical condition to participate in the Pirate Lacrosse ProgramsActivity and have no illness, disease or existing injury or physical defect that would be aggravated by my participation. I hereby assume acknowledge and represent that: (1) I shall at all risks associated with lacrossetimes follow all the rules and regulations for the Activity, including as may be established or modified by Company; (2) I shall not consume or be under the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE influence of any alcohol or drugs at any time while participating in the Activity; and (3) I have fully read and understands each of the negligence provisions of Pirate Lacrossethis Agreement, and I hereby agree NOT TO XXX Pirate Lacrosse, nor their sponsors, directors, officers, employees, coaches, volunteers, instructors, agents, partners, sponsors, nor any of their affiliates (“Pirate Lacrosse Parties”) and I release the Pirate Lacrosse Parties from any and all liability, claims or demands of every kind and nature whatsoever which may arise out of the Player’s participation in activities arranged by Pirate Lacrosse. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common prior to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programs. I release the Pirate Lacrosse Parties and fully accept the risk of any damage to property arising out of the Pirate Lacrosse Programs. This release will serve as a release and assumption of risk which binds my heirs, executors and administrators and for all members of my family. I further state that I am of lawful age and legally competent to agree to signing this waiver and release, and that I understand the terms herein are contractual and binding. I further acknowledge that this risk inherit in the Activity may involve unforeseen consequences, including those which may be due to the unavailability of immediate emergency medical care. I understand that the Activity may not be supervised and that the Company does not provide medical services. I further acknowledge that any injury I may sustain in relation to the Activity may be compounded by negligent or delayed medical service. I VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO MY USE OF AND PARTICPATION OF ACTIVITIES ON THE PREMISES, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE. RELEASE FROM LIABILITY I hereby agree, on behalf of myself, my heirs and my personal representatives, to fully and forever discharge and release the Company and its affiliates, and their respective partners, agents, operators, managers, employees, and representatives (“Released Parties”) from any and all claims I may have or hereinafter have for any injury, temporary or permanent disability, illness, death, damages, liabilities, expenses and/or causes of action, now known or hereinafter known in any jurisdiction in the world, attributable or relating in any manner to my performance or other’s performance of the Activity, whether caused by the negligence of the Company or any of the Released Parties or by any other reason. I acknowledge and agree that this Waiver is intended to be, and is, a complete release of any responsibility of the Released Parties for any and all personal injuries, temporary or permanent disability, death, and/or property damage sustained by me while participating in the Activity and/or on Company’s premises. COVENANT NOT TO SUE I hereby knowingly and voluntarily waive, release, forever discharge and agree not to sue the Company and its partners or leaseholders, including, without limitation, each of their respective affiliated entities, parent companies, agents, attorneys, assigns, representatives, partners, officers, elected officials, employees, and personnel (collectively, "Releasees") from and with respect to any and all actions, causes of action, claims, demands, obligations, liabilities, losses, costs or expenses for, without limitation, personal injury, disability, property damage, illness or wrongful death arising out of my participation in the Activity or any activities incidental thereto, wherever or however the injury or death or damage may occur, whether the same shall arise by the negligence of any of Releasees or otherwise, that may be made by me, or my parent(s) or legal guardian(s), family members, estate, heirs, assigns, personal representatives, next of kin, or spouse (together, "My Representatives"). IT IS THEREFORE MY INTENTION TO EXEMPT AND RELIEVE RELEASEES FROM ALL LIABILITY, INCLUDING, BUT NOT LIMITED TO, LIABILITY FOR PERSONAL INJURY, DISABILITY, PROPERTY DAMAGE, OR DEATH, INCLUDING, WITHOUT LIMITATION, THAT CAUSED BY RELEASEES' ACTUAL OR ALLEGED NEGLIGENCE. INDEMNIFICATION I agree, on behalf of myself and My Representatives, that I or My Representatives shall indemnify and hold harmless Releasees in the event any claims, demands, causes of action, obligations, liabilities, damages, losses, injuries, costs, expenses, and attorney's fees for, including but not limited to, any claim for my personal injury, disability, property damage or wrongful death arising out of my participation in the Activity, including alleged acts of negligence by Releasees, shall be prosecuted against Releasees. Further, it is agreed that the foregoing indemnity and agreement to hold harmless does not require the Releasees to have made payment to a third party claimant as a condition precedent to recovery of the indemnity granted pursuant to this waiver and releaseparagraph.

In exchange I acknowledge that risks of travel include possible political and social upheavals and terrorism, and that I should consult the United States State Department (xxx.xxxxx.xxx) for the right for the Player all areas I plan to participate travel. I hereby personally assume all risks, whether foreseen or unforeseen, arising out of or in connection with my participation in the Pirate Lacrosse Programsindependent study/internship experience, for any harm, injury or damage that may befall me while participating in any activities connected with the independent study/internship experience and travel to and from the site. I hereby assume all risks associated also understand that my baggage and personal property are at my risk entirely throughout the independent study/internship experience and any travel incident thereto. GOVERNING LAW: I agree that this Agreement will be construed in accordance with lacrossethe laws of the State of Washington and King County and will be the forum for any legal dispute concerning my participation in the independent study/internship experience. RELEASE OF CLAIMS: I, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosseindividually, and I on behalf of my heirs, successors, assigns and personal representatives, hereby agree NOT TO XXX Pirate LacrosseRELEASE and FOREVER DISCHARGE Seattle University, nor their sponsorsits employees, directorsagents, officers, trustees, contractors and representatives (in their official and individual capacities) from any and all liability whatsoever for any and all damages, losses or injuries (including death) I sustain to my person or property or both, including but not limited to any claims, demands, actions, causes of action, judgments, damages, expenses and costs, including attorney’s fees, which arise out of, result from, occur during or are connected in any manner with my participation in the independent study/internship experience, any related or independent travel, and any activities, excursions, side trips or field trips in which I participate during the independent study/internship experience, irrespective of whether or not they are sponsored, supervised or controlled by Seattle University in any manner. INDEMNIFICATION AND HOLD HARMLESS: I, individually, and on behalf of my heirs, successors, assigns and personal representatives, hereby agree to INDEMNIFY, DEFEND and HOLD HARMLESS Seattle University, its employees, coaches, volunteers, instructors, agents, partnersofficers, sponsorscontractors, nor any of trustees and representatives (in their affiliates (“Pirate Lacrosse Parties”official and individual capacities) and I release the Pirate Lacrosse Parties from any and all liability, claims loss, damage or demands of every kind and nature whatsoever which may expense, including attorneys fees, that arise out of the Player’s of, occur during, or are in any way connected with or related to my participation in activities arranged the independent study/internship experience, any related or independent travel, and any activities, excursions, events or field trips in which I participate during the independent study/internship experience, irrespective of whether or not they are sponsored, supervised or controlled by Pirate LacrosseSeattle University in any manner. I agree NOT TO XXX have carefully read and understand everything written above, and I release voluntarily sign this Agreement to Participate, Assumption of Risk and Release. No representation, statements or inducements, oral or written, apart from the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated with the Pirate Lacrosse Programsforegoing statement have been made. I release the Pirate Lacrosse Parties and fully accept the risk am at least 18 years of any damage to property arising out of the Pirate Lacrosse Programs. I understand that the University does not extend workers' compensation coverage to students participating in University-related or University- sponsored internship programs and I further understand that the organization I perform my internship with may not be required to provide workers’ compensation coverage for me and may not have volunteer accident insurance. I agree NOT TO XXX to receive informational and I release the Pirate Lacrosse Parties and fully accept the risk of any illness or injury suffered by the Player while taking part in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated marketing emails from ReadySetSweat LLC with the Pirate Lacrosse Programsoption to unsubscribe at any time. I release the Pirate Lacrosse Parties hereby grant permission for videos and fully accept the risk of any damage photographs to property arising out of the Pirate Lacrosse Programs. The Participant acknowledges and fully understands that as a participant in The Oakland Role, the Participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, property loss and severe social and economic losses. I agree NOT TO XXX and I release the Pirate Lacrosse Parties and fully accept the risk property or damages, of any illness nature whatsoever, including, but not limited to, transportation accidents arising during The Oakland Role and any claim for negligence, which the Participant may ever have, now have, or injury suffered which the Participant's heirs, representatives, executors, administrators, and assigns may now have, or have in the future against the Released Persons (including attorneys' fees incurred by the Player while taking part Released Persons, in the Pirate Lacrosse Programs (including injuries that might cause death), including the ones listed above and other injuries common to contact sports and injuries (including injuries that might cause death) that may arise during travel associated connection with the Pirate Lacrosse Programs. These risks may lead to tangible or intangible harm, and I agree that they may result not only from my own actions but also from the actions of others. I choose to participate in this hunting program in spite of these named risks and other unnamed risks which are inherent in this activity. I am solely responsible for deciding what equipment to take and whether or not to scout the Pirate Lacrosse Programsassigned property. In consideration of Washington SWCD furnishing services to enable me to participate in a hunting program, I hereby assume all risks risk of injury or loss of life to myself and loss of or damage to the property arising out of my participation in such a program, including hazards associated with lacrosse, including the RISK OF SERIOUS BODILY INJURY, DEATH and/or PROPERTY DAMAGE and the negligence of Pirate Lacrosse, and any defect in a manufacturer’s product. Assumption of Risk. In exchange for I am fully aware that there may be risks and hazards associated with being present upon and using the right for Facility, and I, or the Player Participant, elect to voluntarily be present upon and use the Facility knowing that there may be risks or hazards.
