ARTICLE SIX. Total Cost of the Project: 6.1. The total cost of the project shall be for the amount of Bahraini Dinars. 6.2. The Second Party shall pay the costs of the project according to what is explained in the Expenses annex and referred to as Annex (2). 6.3. Annex (2) shall form an integral part of this Agreement and shall be read and interpreted as though expressly set out in the body of this Agreement. 6.4. If the Second Party fails to settle the expenses paid by the First Party within the durations stated in this Agreement, then the Second Party shall pay a monthly penalty equivalent to 1% of the amount of the unsettled costs, the penalty amount shall not exceed 10% of the overall total cost of the Project. 6.5. If the delay in payments is due to the First Party’s actions, then the Second Party shall not be penalized. 6.6. If the Parties do not agree on who to attribute the reason for delay in payment to or if it is attributed to both Parties, then the Engineering Office’s opinion regarding this issue shall prevail. 6.7. If either Party objects to the opinion of the Engineering Office, then the objecting Party may refer the issue to the concerned Court to decide on whose fault it was. 6.8. The payments shall either be through paper or electronic cheques issued to the name of the First Party, or through a bank transfer to the First Party’s bank account at ------------ Bank and holder of bank account number --.

  • Section Five In the event the Commissioner of Administrative Services or designee disapproves the requested assignment on the basis of his/her judgment that the assignment does not constitute temporary service in a higher class, the employee shall continue working as assigned with recourse under the appeal procedure for reclassification but not under the grievance and arbitration procedure. The form certifying the assignment will specify the rights and obligations of the parties under Sections Four and Five.
