Appointment as the Custodian. Subject to the terms and conditions herein, the Trustee hereby appoints the Custodian, and the Custodian hereby accepts such appointment, to maintain custody of the Files relating to the Land-and-Home Contracts and Mortgage Loans, if any, listed on Schedule I hereto (the "Schedule"). The Custodian shall have no duties or obligations except those expressly stated in this Agreement, and such duties or obligations shall be determined solely by the express provisions of this Agreement.
