Common use of Appointment; Acceptance Clause in Contracts

Appointment; Acceptance. The Custodian, in consideration of the deposit by the Program Sponsor of funds into the Custodial Account, and other valuable consideration, hereby agrees to act as custodian of the Account on the terms and conditions of this Agreement. The Program Sponsor, in consideration of the agreement by the Custodian to perform the duties of a custodian under this Agreement, hereby designates and appoints the Custodian as the custodian of the Participant Account.
