Common use of Applicable Borrower Clause in Contracts

Applicable Borrower. The undersigned Borrower hereby represents and warrants that (a) such request complies with the requirements of Section 2.01 of the Credit Agreement and (b) each of the conditions set forth in Section 4.02 of the Credit Agreement have been satisfied on and as of the date of such Borrowing, conversion or continuation.

Applicable Borrower. The With respect to such Borrowing, the undersigned Borrower hereby represents and warrants that (ai) such request complies with the requirements of Section 2.01 2.05(a) of the Credit Agreement and (bii) each of the applicable conditions set forth in Section 4.02 of the Credit Agreement have been satisfied on and as of the date of such Borrowing, conversion or continuation.
