Apparent Authority. No purchaser, seller, transfer agent or other Person dealing with the Trustees or any officer, employee or agent of the Trust shall be bound to make any inquiry concerning the validity of any transaction purporting to be made by the Trustees or by such officer, employee or agent or make inquiry concerning or be liable for the application of money or property paid, transferred or delivered to or on the order of the Trustees or of such officer, employee or agent.
Apparent Authority. Any person dealing with the Trustee in respect of any matter pertaining to the Trust Fund and any right, title or interest therein shall be entitled to rely on a certificate, statutory declaration or resolution executed or certified on behalf of the Trustee as to the capacity, power and authority of any officer, employee or any other person to act for and on behalf and in the name of the Trust.
Apparent Authority. Wicker shall have no authority to contract for or obligate New Sky in any respect except that provided in writing by New Sky.
Apparent Authority. The Company acknowledges the authority granted to the Agent by the Lenders and shall be permitted to rely exclusively, without further investigation, upon the representations, consents, waivers and all other actions taken by the Agent. The Company, for itself and its affiliates and their successors and assigns, hereby acknowledges that at all times prior to the execution and delivery by the Agent of this Agreement, the Company has accepted and relied upon, and will continue to accept and rely upon the actual and apparent authority of the Agent acting alone and without further authorization from the Lenders or any of them, with respect to any or all of the rights, powers, authority or remedies granted or reserved to the Agent or the Lenders, the Loan Documents, or the Notes or any of them. The Company acknowledges and agrees that the Agent has all right and apparent and actual authority to exercise alone the rights, powers, and remedies granted or reserved to the Agent or the Lenders under this Agreement, the Notes and the Loan Documents without further evidence of such authority or confirmation thereof from or by any Lender.
Apparent Authority. Company stipulates that any action that IC takes hereunder is pursuant to apparent authority of Processor and Company, its agents, assigns, officers, directors, employees. In the event that Processor’s and/or Company's agent, assigns, officers, directors, or employees does not have the authority to the debit or the credit process by IC, Processor and Company hereby hold IC harmless from such actions and agrees to indemnify IC for such action pursuant to this Agreement. Processor and Company stipulate and agree that Company and not IC is liable for such action.
Apparent Authority. Owner agrees that anyone in possession or in charge of Owner's vessel shall be deemed to have the authority to act on behalf of Owner and the City shall be entitled to rely upon orders or requests by such persons for services, supplies, work, labor and other like matters supplied or furnished for the benefit of Owner's vessel, unless the Owner notifies the City in writing to the contrary.
Apparent Authority. Company stipulates that any action that PS takes hereunder is pursuant to apparent authority of Company, its agents, assigns, officers, directors, employees. In the event that Company’s agent assigns, officers, directors, employees does not have the authority to the debit or credit process by PS, Company hereby holds PS harmless from such actions and agrees to indemnify pursuant to this Agreement PS for such action. Company stipulates and agrees that Company and PS is liable for such action.

Apparent Authority. ARCA is solely responsible for the use of the System by RCA, its employees, its agents and any individual with apparent authority to use the System (collectively referred to as “Authorized Agents”). Any order entered shall be deemed to be entered by an Authorized Agent so long as the access is gained through use of ARCA’s logon and password and/or BNPPBS reasonably believes that the order entered is genuine. Any claims, liabilities, damages, losses or fines assessed as a result of any order entered by an Authorized Agent, regardless of whether entered by mistake, shall be borne by ARCA.
Apparent Authority.
