Common use of Annual Accountants’ Reports Clause in Contracts

Annual Accountants’ Reports. Within one hundred and twenty (120) days after the end of each fiscal year, commencing with the fiscal year ending on or around December 30, 2017, each of the Co-Issuers shall furnish, or cause the applicable Manager to furnish, to the Trustee, the Servicer and each Rating Agency the reports of the Independent Auditors or the Back-Up Manager required to be delivered to such Co-Issuer by the applicable Manager pursuant to the applicable Management Agreement.

Within one hundred and twenty eighty (120180) days after the end of each fiscal year, commencing with the fiscal year ending on or around December 3031, 20172023, each of the Co-Issuers Manager shall furnish, or cause the applicable Manager to furnish, to provide the Trustee, the Servicer and Servicer, the Control Party, each Rating Agency and the Back-Up Manager (to the extent that the Back-Up Manager is not providing such report) with the reports of the Independent Auditors or the Back-Up Manager required to be delivered to such the Co-Issuer Issuers by the applicable Manager pursuant to Section 3.3 of the applicable Management Agreement.
