Common use of ALPS Appointment and Duties Clause in Contracts

ALPS Appointment and Duties. (a) The Trust on behalf of the Fund hereby appoints ALPS to provide the administrative, bookkeeping and pricing services for the Fund set forth in Appendix B hereto, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS Appointment and Duties. (a) The Trust on behalf of the Fund Funds hereby appoints ALPS to provide the administrative, bookkeeping and pricing services for the Fund Funds set forth in Appendix B hereto, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund Funds in any way or otherwise be deemed an agent of the FundFunds.

(a) The Trust Trust, on behalf of the Fund relevant Fund, hereby appoints ALPS to provide the administrative, bookkeeping and pricing distribution services for the Fund set forth in this Agreement on Appendix B heretoB, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund in any way or otherwise be deemed an agent of the Trust or the Fund.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund Funds in any way or otherwise be deemed an agent of the FundTrust or the Funds.

ALPS hereby accepts such appointment and agrees to furnish such specified servicesthe Services. ALPS shall for all purposes be deemed to be an independent contractor in connection with providing the Services and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund in any way or otherwise be deemed an agent of the FundFund with respect to providing the Services.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund in any way or otherwise be deemed an agent of the Fund.

ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust Fund or the Fund DIVIDEND CAPITAL in any way or otherwise be deemed an agent of the FundFund or DIVIDEND CAPITAL.

ALPS Appointment and Duties. (a) The Trust on behalf of the Fund Funds hereby appoints ALPS to provide the administrative, bookkeeping transfer agent and pricing other specified services for the Fund set forth in Appendix B hereto, as amended from time to time, upon the terms and conditions hereinafter set forth. ALPS hereby accepts such appointment and agrees to furnish such specified services. ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund in any way or otherwise be deemed an agent of the FundTrust or the Funds.

ALPS shall for all purposes be deemed to be an independent contractor and shall, except as otherwise expressly authorized in this Agreement, have no authority to act for or represent the Trust or the Fund in any way or otherwise be deemed an agent of the FundTrust.
