Allowed Capacity Clause Samples
Allowed Capacity. The net instantaneous MW output from the Facility may not exceed the Allowed Capacity. Company may take appropriate action to limit the Actual Output pursuant to, but not limited to, Article 8 (Company Dispatch), Article 9 (Personnel and System Safety), Article 25 (Good Engineering and Operating Practices), and Attachment B (Facility Owned by Seller). Company shall not be required to pay for any Actual Output of the Facility which exceeds the Allowed Capacity.

Seller shall take all necessary affirmative action to limit Actual Output to no more than the Allowed Capacity. Company may take appropriate action to limit the Discharge Energy pursuant to, but not limited to, Article 12 (Dispatching and Charging the Facility; Scheduling); Article 16 (Personnel and System Safety), Attachment B (Facility Owned by Seller) and Good Engineering and Operating Practices. Company shall not be required to pay for any Discharge Energy.

The net instantaneous MW output from the Facility may not exceed the Allowed Capacity except to the extent that Company has requested and Seller has agreed, in their sole discretion, to exceed the Allowed Capacity. Where Company has not requested Seller to exceed the Allowed Capacity, Seller shall take all necessary affirmative action to limit Actual Output of the Facility to no more than the Allowed Capacity. Company may take appropriate action to limit the Actual Output pursuant to, but not limited to, Article 8 (Company Dispatch), Article 9 (Personnel and System Safety), Article 25 (Good Engineering and Operating Practices), and Attachment B (Facility Owned by Seller). Company shall not be required to pay for any Actual Output of the Facility which exceeds the Allowed Capacity.
Allowed Capacity. The maximum instantaneous active power (MW) from the Facility may exceed the ▇▇▇▇ Contract Capacity. Company may dispatch up to Dispatch Limits in accordance with Article 8 (Company Dispatch) and Attachment B (Facility Owned by Seller). Company may limit the net instantaneous MW output of the Facility pursuant to, but not limited to, Article 8 (Company Dispatch), Article 9 (Personnel and System Safety), Article 25 (Good Engineering and Operating Practices), and Attachment B (Facility Owned by Seller). Company shall not be required to pay for any Discharge Energy.
Allowed Capacity. The maximum Capacity agreed upon between the Company and the Seller that may be delivered to the Company at any one time by the Seller, unless the Company requests otherwise, which shall be thirty megawatts (30 MW).

Subscriber Organization shall take all necessary affirmative action to limit Actual Output to no more than the Allowed Capacity. Company may take appropriate action to limit the Actual Output pursuant to, but not limited to, Article 8 (Company Dispatch), Article 9 (Personnel and System Safety), Article 25 (Good Engineering and Operating Practices), and Attachment B (Facility Owned by Subscriber Organization). Company shall not be required to pay for any Actual Output of the Facility which exceeds the Allowed Capacity.
Allowed Capacity. The Capacity Available for Dispatch from the Facility may exceed the Contract Capacity. Company may dispatch up to the Capacity Available for Dispatch in accordance with Article 8 (Company Dispatch). Company may limit the net instantaneous MW output pursuant to, but not limited to, Article 8 (Company Dispatch), Article 9 (Personnel and System Safety), Article 25 (Good Engineering and Operating Practices), and Attachment B (Facility Owned by Seller).
Allowed Capacity. The Allowed Capacity of this Contract shall be the lower of (i) 30,000 kW, or (ii) the net nameplate capacity (net for export) of the wind turbine generators that have been installed and have successfully completed the Control System Acceptance Test(s), to the extent applicable, by the In-Service Date.
Allowed Capacity. The Available Capacity from the Facility may exceed the Allowed Capacity if Company specifically requests such output, however, only to the extent of Company’s request. Company may take appropriate action to limit the Net Electric Energy Output pursuant to, but not limited to, Section 2 (Control of Facility) of Attachment Y (Operation and Maintenance of the Facility), Section 5 (Personnel and System Safety) of Attachment Y (Operation and Maintenance of the Facility), Good Engineering and Operating Practices and Attachment B (Facility Owned by EXECUTION VERSIONPuna Geothermal Venture ARTICLE 348 Seller). Company shall not be required to pay for any Net Electric Energy Output of the Facility which exceeds the Allowed Capacity unless Company has requested such output in excess of Allowed Capacity and only to the extent of such request. Company shall not be required to pay any additional capacity payment for any additional power supplied by Seller, either at Company’s or Seller’s request.
