Common use of Allocation Amount Clause in Contracts

Allocation Amount. In the event that the Holder shall exercise all of this Warrant into a number of shares of Common Stock that, in the aggregate, is less than the Holder's Cap Allocation Amount, then the difference between the Holder's Cap Allocation Amount and the number of shares of Common Stock actually issued to such Holder shall be allocated to the respective Cap Allocation Amounts of the Investors on a pro rata basis in proportion to the number of Warrant Shares issuable upon exercise then held by the Investors.

Allocation Amount. In the event that the Holder shall exercise all of this Warrant into a number of shares of Common Series B Preferred Stock that, in the aggregate, is less than the Holder's Cap Allocation Amount, then the difference between the Holder's Cap Allocation Amount and the number of shares of Common Series B Preferred Stock actually issued to such Holder shall be allocated to the respective Cap Allocation Amounts of the Investors on a pro rata basis in proportion to the number of Warrant Shares issuable upon exercise then held by the Investors.
