The Issuer is not subject to any charter, by-law or contractual limitation or provision of any nature whatsoever which in any way limits, restricts or prevents the Issuer from entering into the Second Supplemental Indenture and this Second Supplemental Lease or performing any of its obligations under the Lease or the Indenture.
