AGREEMENT AND MODIFICATION. 10.1 Any change in terms of this Agreement shall be valid only if the change is made in writing. The Agreement contains the whole agreement between the parties in respect of its subject matter and supersedes any prior written or oral agreement between them, and the parties confirm that they have not entered into the Agreement on the basis of any representations that are not expressly incorporated in the Agreement. Nothing in the Agreement will operate to limit or exclude any liability for fraud.
