Agreement and Contract. Article 1 (Objective) The objective of this Agreement is to establish basic conditions under which Seller sells the Products to Buyer and Buyer purchases the same.
Agreement and Contract. This Contract is and shall be deemed to be a contract entered into and made pursuant to the laws of the State of Massachusetts and shall in all respects be governed, construed, applied and enforced in accordance with the laws of said State, without reference to its conflict of laws principles. Any lawsuit or litigation commenced relative to this Contract or any dealings between the Parties shall be brought in Middlesex County, Massachusetts. Both Parties consent to the jurisdiction and venue described herein. Payments to Xxxxx Associates, Inc., for services requested by opposing parties, including, but not limited to, deposition testimony, responses to interrogatories, requests for production of documents, and providing copies of case files and materials, are the direct responsibility of the undersigned and must be made in accordance with the terms and conditions specified under Xxxxxxxx above. Responsibility for reimbursement by opposing parties for any such payments rests likewise with the undersigned. The undersigned agrees that, upon being retained, Xx. Xxxxx will be entitled to copies of all opposing expert witness deposition transcripts and any papers or documents produced by them during and related to the litigation to which this Contract applies. Agreement and Contract. A. It is understood and agreed that the terms and conditions hereof apply to "paid firefighters" while engaged in the services and duties as "paid firefighters", that the aforesaid terms and conditions do not apply with respect to any "paid firefighter" who shall be engaged as a "volunteer" which volunteer shall receive such benefits and emoluments as are provided by law for volunteers.
