Common use of Agents and Affiliates Clause in Contracts

Agents and Affiliates. Each Agent in its individual --------------------- capacity and not as Agent hereunder shall have the same rights and powers under this Agreement as any other Bank and may exercise or refrain from exercising the same as though it were not an Agent hereunder and each Agent in its individual capacity and not as Agent hereunder may accept deposits from, lend money to, and generally engage in any kind of business with Borrower and its Subsidiaries and Affiliates as if such parties were not Agents hereunder.
