Agent Matters. The Company and each Undersigned Party acknowledge that each of ▇.▇. ▇▇▇▇▇▇ Securities LLC and Nordea Bank Abp (each, an “Agent”) shall be entitled to rely on the representations and warranties of such Undersigned Party contained in Section 3.04, Section 3.07 and Section 4.11 of this Agreement. Each party agrees that the delivery of the ADS Consideration at Closing will constitute a reaffirmation of its own acknowledgments, understandings, agreements, representations and warranties herein (as modified by any such notice) as of the Closing. The Company and each Undersigned Party further acknowledge and agree that each Agent is a third-party beneficiary of the representations and warranties of such Undersigned Party contained in Section 3.04, Section 3.07 and Section 4.11 of this Agreement.
