After Hours HVAC Service. During the Substitution Term, in lieu of Landlord’s obligation to provide free after-hours HVAC service under Section 7.01 of the Original Lease, Landlord shall provide the original Tenant only (and to any entity pursuant to a Permitted Transfer), on a non-cumulative basis, with up to 120 hours per year (on a calendar year basis, prorated for any partial calendar year) of after-hours HVAC service. In no event shall Tenant be entitled to carry-over any unused portion of such 120 hours per year of free after hours HVAC service from year to year during the Substitution Term.
After Hours HVAC Service. Tenant shall give reasonable advance notice in making any request for air circulation, heating, or cooling required outside of Building Standard Hours; as of the execution of this Lease, Landlord has not designed the system that will be used to make such request (it might be telephonic, via an internet program, or a physical switch located in the Premises). Tenant agrees to pay, as Additional Rent, within thirty (30) days after demand, Landlord’s then-standard charge for providing after-hours air circulation, heating, and cooling, which charge shall be based on Landlord’s actual direct and indirect costs of providing such services (including utility costs, taxes, engineers’ costs, and a reasonable charge for wear and tear on the applicable Building System), provided that in no event shall Landlord impose any administrative fee or other similar ▇▇▇▇-up on such costs. Landlord estimates that the current rate for service until this Section 8.5 is Fifty-three and no/100ths Dollars ($53.00) per hour per floor during such hours that fall within the peak-demand hours for PG&E (currently 3:00 PM to 11:00 PM) and Thirty-one and no/100ths Dollars ($31.00) per hour at all other times. The rate for service under this Section 8.5 shall be calculated using only the costs attributable to providing the service to the floor for which Tenant requests service, notwithstanding that if, by reason of the design of the Building’s HVAC system Landlord must actually provide air circulation, heating, or cooling to other floors of the Building in order to accommodate Tenant’s request for service; provided, however, that if in any given calendar day Tenant requires in excess of eight (8) hours of overtime service, the limitations set forth in this sentence above shall not apply to any such excess hours.
After Hours HVAC Service. After hours HVAC charges are $20.00 per hour. Building standard hours are 6:00 a.m. to 6:00 p.m. Monday through Friday and 6:00 a.m. to 12:00 p.m. on Saturday.
After Hours HVAC Service. As of the Effective Date, Tenant shall have the right, from time to time, but no more frequently than once per calendar year, to elect by written notice to Landlord to pay, in lieu of hourly charges for After-Hours HVAC service on Mondays through Saturdays on the twenty-fifth (25th) and/or twenty-sixth (26th) floors, a flat annual charge of Eighteen Thousand Five Hundred Sixty and 00/100 Dollars ($18,560.00) per floor. If Tenant elects to exercise such right, then HVAC operation on the floor or floors selected by Tenant shall be extended to twenty-four (24) hours per day from 7:00 A.M. to 7:00 A.M. Tenant shall have the right thereafter, from time to time, to change its election from hourly to the foregoing flat charge and vice versa based on its use of one or both of such floors.
