Common use of Advance Not A Waiver Clause in Contracts

Advance Not A Waiver. No Advance will constitute a waiver of any condition precedent to any obligation of Lender to make any further Advances or preclude Lender from thereafter declaring the failure of Borrower to satisfy the condition precedent to be an Event of Default.

No Advance will shall constitute a waiver of any condition precedent to any of the conditions of Lender’s obligation of Lender to make further Advances, nor, if Borrower is unable to satisfy any further Advances or condition, shall the Advance preclude Lender from thereafter then declaring the failure of Borrower to satisfy the condition precedent that inability to be an Event of Default.
