Common use of Additional Bargaining Clause in Contracts

Additional Bargaining. The parties acknowledge that during the negotiations which resulted in this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject or matter not removed by law or by specific agreement of the parties. Therefore, the Board and Association for the life of this Agreement each voluntarily and unqualifiedly waive any right which may otherwise exist to negotiate over a matter within a general subject area which either is referred to in this Agreement or which was referred to in a proposal or counterproposal made by either party during the course of negotiations during the term of this Agreement, and each agrees that the other shall not be obligated to bargain collectively with respect to any specific matter within such general subject area whether or not specifically referred to or covered in this Agreement.

Additional Bargaining. The parties acknowledge that during the negotiations which resulted in this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any matter or subject or matter not removed by law or by specific agreement of the partiesparties from the area of collective bargaining, and that the understanding and agreements arrived at by the parties after the exercise of that right are set forth in this Agreement. Therefore, the Board and Association the Association, for the life of this Agreement Agreement, each voluntarily and unqualifiedly waive any right which may might otherwise exist under law, practice or custom to negotiate over a any matter within a general subject area which either is referred to in this Agreement or which was referred to in a proposal or counterproposal made by either party during the course of negotiations during the term of this Agreement, and each agrees that the other shall not be obligated to bargain collectively with respect to any specific subject or matter within such general subject area whether or not specifically referred to or covered in this Agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both of the parties at the time that they negotiated or signed this Agreement.
