Addition and Deletion of Program Recyclable Materials Clause Samples

The 'Addition and Deletion of Program Recyclable Materials' clause defines the process by which materials eligible for recycling under a program can be added or removed. Typically, this clause outlines the criteria or procedures for updating the list of recyclable items, such as requiring mutual agreement or notice between parties before changes take effect. Its core function is to provide flexibility and adaptability to the recycling program, ensuring it can respond to changes in recycling technology, market demand, or regulatory requirements.
Addition and Deletion of Program Recyclable Materials. City reserves the right to add other Recyclable Materials to the program or delete Recyclable Materials from the program if the Parties agree it is economically and technically feasible. An increase or decrease in fees, if any, for addition or deletion of Recyclable Materials may be negotiated and implemented as a change in rate schedule by an amendment to this Agreement executed by the Parties.
Addition and Deletion of Program Recyclable Materials. The Town reserves the right to add other Program Recyclable Materials to the program if the processing facility accepts such material from other customers or if the parties agree it is economically and technically feasible. In addition, the Town reserves the right to delete Program Recyclable Materials from the program if the parties agree it is economically and technically prohibitive.
Addition and Deletion of Program Recyclable Materials. Program Recyclable Materials shall also include other recyclable materials proposed by the Contractor and agreed to by the City-Parish. If during the term of this Contract the Materials Recovery Facility processes any recyclable materials other than Program Recyclable Materials, the City-Parish may, at its sole discretion, add such recyclable materials to defined Program Recyclable Materials. Additionally, if another Materials Recovery Facility in the Service Area accepts other recyclable materials not currently included as Program Recyclable Materials, the City-Parish may, at its sole discretion, include such other recyclable materials as Program Recyclable Materials at no additional cost to the City-Parish unless the Contactor can prove that adding such recyclable material as Program Recyclable Materials would cause an unreasonable financial hardship to the Contractor and/or no market exists for such recyclable materials. The City-Parish may remove a recyclable material from Program Recyclable Materials if the City-Parish and Contractor determine it is economically and technically prohibitive to process such recyclable materials and can reach agreement as to the financial impact for deletion of such recyclable materials from Program Recyclable Materials.
Addition and Deletion of Program Recyclable Materials. City reserves the right to add other Recyclable Materials to the program if (i) Processing Facility Processing Program Recyclable Materials Collected via this Contract accepts such material, (ii) Processing Facility Processing Program Recyclable Materials Collected from the City of Austin accepts such material, or
